Welcome to Ekam Yogastra! These Terms & Conditions (“Agreement”) govern your use of the Ekam Yogastra website, and your participation in any class, session, program, workshop, retreat, or service offered by Ekam Yogastra (“the Client,” “you”), whether online, in-studio, or at a location of your choosing. By accessing this Website, registering for a service, or clicking “I Agree,” you confirm that you have read, understood, and voluntarily accepted all terms below. If you do not agree, please refrain from using the Website or our services.
This Agreement is binding upon the Client, their heirs, legal representatives, successors, executors, administrators, family members, and assigns. It constitutes the entire understanding between the Client and Ekam Yogastra and supersedes any prior verbal discussions, advertisements, promotional materials, or informal communications. Any verbal assurances, social media content, or website information shall not override these terms unless confirmed in writing by an authorized representative of Ekam Yogastra.
You represent that you are at least 18 years old, or that you have obtained parental/legal guardian consent. For clients below 18 years of age, this Agreement must be signed by a parent or legal guardian, who accepts full responsibility for the minor’s participation and compliance with these terms.
Certain areas of the website may require registration. You agree to provide accurate, up-to-date information and to keep your login credentials secure. You are solely responsible for the confidentiality of your account. The Client also agrees to provide complete and truthful information regarding medical conditions, physical limitations, surgeries, injuries, pregnancy, psychological conditions, current medications, allergies, and existing diagnoses – see Section 8 (Medical Disclosure) below.
All courses consist of a maximum of 20 sessions unless otherwise specified in writing. Unused sessions must be completed within the validity period of the purchased package, subject to the attendance and rescheduling policy in Section 14.
You voluntarily choose to participate in yoga classes, yoga therapy, meditation, pranayama, wellness consultations, lifestyle guidance, workshops, retreats, online programs, and all other Ekam Yogastra services. Participation is entirely voluntary, and you may discontinue at any time.
You understand and acknowledge that yoga, yoga therapy, meditation, stretching, breathing techniques, and other physical or wellness activities involve inherent risks, including but not limited to muscle strains, ligament or joint injuries, sprains, fractures, dizziness, fainting, fatigue, elevated heart rate, aggravation of pre-existing conditions, physical discomfort, emotional release reactions, and unexpected medical complications. No physical activity can be guaranteed to be completely risk-free.
Ekam Yogastra, its instructors, therapists, employees, contractors, consultants, and representatives are not acting as medical doctors unless explicitly stated. Services are educational, therapeutic, preventive, and wellness-oriented. No statement made by Ekam Yogastra shall be construed as a medical diagnosis, prescription, medical treatment, cure guarantee, or replacement for professional healthcare. Clients are advised to seek independent medical advice whenever necessary.
Ekam Yogastra makes no guarantee, warranty, or representation regarding weight loss, pain relief, disease reversal, psychological improvement, medical recovery, fitness improvement, or any specific therapeutic outcome. Individual results vary significantly, and no promise of results has been made to you.
You agree to provide complete, truthful, and accurate information regarding medical conditions, physical limitations, surgeries, injuries, pregnancy, psychological conditions, current medications, allergies, and existing diagnoses. Failure to disclose any such information constitutes a material breach of this Agreement, and Ekam Yogastra is not responsible for injuries, complications, or damages arising from undisclosed medical conditions.
You knowingly, voluntarily, and expressly assume all risks – known and unknown, foreseeable and unforeseeable – associated with participation in any Ekam Yogastra activity, and accept full personal responsibility for your participation. You agree that you are solely responsible for monitoring your own physical condition, recognizing your limitations, seeking medical clearance when necessary, and stopping participation if discomfort occurs. Instructors cannot continuously monitor every participant.
For online classes: internet disruptions and technical failures may occur, instructors cannot physically assist you, and you participate entirely at your own risk. You are responsible for maintaining a safe practice environment.
This Agreement applies to all services provided at the Client’s residence or any location requested by the Client, including home classes, private sessions, yoga therapy, and wellness consultations. Ekam Yogastra and its instructors are not responsible for injury, loss, damage, accident, unsafe conditions, third-party actions, pets, furniture-related hazards, or environmental risks at the Client’s chosen location. The Client agrees to provide a safe, clean, and suitable space and accepts full responsibility for the condition of the premises.
For international students and clients participating from outside India, this Agreement remains fully applicable. Such participants acknowledge that services are delivered from India and agree to comply with all applicable laws, health requirements, internet usage policies, and legal obligations in their country of residence. International clients are solely responsible for ensuring participation is lawful in their jurisdiction, for any visa, travel, medical, accident, or personal liability insurance they consider necessary, and for any immigration, taxation, or cross-border compliance matters. Ekam Yogastra is not liable for any such legal, regulatory, insurance, or compliance issues arising in a participant’s country of residence.
Ekam Yogastra reserves the right to suspend or terminate services without refund where a Client provides false information, behaves abusively, harasses staff, violates studio policies, or creates safety risks.
You grant Ekam Yogastra permission to use photographs, video recordings, testimonials, written feedback, and success stories for educational, marketing, promotional, social media, website, and advertising purposes. This consent may be withdrawn in writing at any time. Conversely, audio recording, video recording, photography, screen recording, or live streaming of any session by a Client is strictly prohibited unless prior written permission has been obtained from Ekam Yogastra.
Ekam Yogastra makes reasonable efforts to maintain the confidentiality of client information. Disclosure may still occur where required by law, ordered by a competent court, necessary to protect safety, or required by a regulatory authority.
While using the Website or our services, you agree not to:
Clients are solely responsible for safeguarding their personal belongings during classes or sessions. Ekam Yogastra is not liable for loss, theft, damage, or misplacement of personal property.
Content on the Website – including text, graphics, logos, images, videos, audio clips, and software – is protected by copyright, trademark, and other intellectual property rights. You may not copy, reproduce, modify, distribute, display, or transmit any portion of the Website without prior written consent from Ekam Yogastra.
Our Privacy Policy governs the collection, use, and disclosure of personal information. By using the Website, you consent to the practices described there.
The Website and services are provided on an “as-is” and “as-available” basis. Ekam Yogastra makes no warranties, express or implied, regarding the operation of the Website, the accuracy of information provided, or the availability, reliability, or security of the Website, to the fullest extent permitted by law.
To the fullest extent permitted by applicable law, by participating in any Ekam Yogastra service or using this Website, you release, waive, discharge, and covenant not to sue Ekam Yogastra and its proprietor, directors, employees, yoga therapists, yoga teachers, consultants, contractors, volunteers, representatives, successors, and assigns from any and all claims, liabilities, damages, losses, costs, injuries, illnesses, disabilities, or death arising from such participation or use, except where liability cannot legally be excluded.
In no event shall Ekam Yogastra, its directors, officers, employees, contributors, or agents be liable for any direct, indirect, incidental, special, punitive, or consequential damages arising out of or in connection with your use of the Website or participation in any service, whether based on contract, tort, negligence, strict liability, or any other legal theory – even if advised of the possibility of such damages.
You agree to indemnify, defend, and hold harmless Ekam Yogastra and its representatives against any claims, damages, liabilities, costs, or expenses arising from: violation of these Terms, your own negligence, your failure to disclose medical conditions, misuse of services, or violation of any rights of another person or entity.
Ekam Yogastra is not liable for service interruptions caused by natural disasters, government restrictions, epidemics, pandemics, internet or power failures, or other events beyond its reasonable control.
Ekam Yogastra reserves the right to modify, suspend, or terminate the Website or any service at any time without prior notice, and may modify these Terms & Conditions from time to time. Continued use of the Website after any update constitutes your acceptance of the revised terms.
You agree that electronic signatures, digital signatures, scanned signatures, OTP confirmations, email confirmations, online acceptance, or clicking “I Agree” carry the same legal validity and enforceability as a handwritten signature, to the extent permitted under applicable law.
If any provision of this Agreement is found invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions continue in full force and effect. A waiver of any provision by Ekam Yogastra does not constitute a continuing waiver of any other provision or future breach.
This Agreement is governed by and construed in accordance with the laws of India. All disputes, claims, or legal proceedings arising out of or relating to this Agreement or any Ekam Yogastra service shall be subject to the exclusive jurisdiction of the competent courts at Dholpur, Rajasthan, India. The Client irrevocably submits to this exclusive jurisdiction and waives any objection relating to venue or forum convenience, to the extent permitted by applicable law.
This Agreement constitutes the entire understanding between you and Ekam Yogastra regarding your use of the Website and participation in our services, and supersedes any prior agreements or understandings, whether written or oral.
